WHAT CAN I DO IF MY FRIEND OR RELATIVE WAS JUST ARRESTED?
When a person is arrested, they have to go before a magistrate. The magistrate sets the amount of their bond. This is usually done very shortly after the person is brought to the jail and booked. If you call us as soon as they are arrested, we can have them out very quickly.
WHAT IS A BOND?
Answer: Is a court ordered amount of money that a defendant must pay to be able to ensure the defendant appears in court. A bond is usually set by a magistrate or judge.
HOW DOES A BOND WORK?
Answer: (a)The defendant can pay the full amount in cash or certified check to the courts. This is known as a cash bond. (b)The defendant can also use property( house or land) against his/her bond. This is known as a property bond (c)The defendant or his/her friends or family can contact a bail bondsman to pay a percentage of the bond amount.(10-15%) The bondsman will post the bond and at that point the bail bondsman in fact becomes the jailer. This is known as a surety bond.
WHAT IS A COSIGNER?
Answer: The co-signer is an individual that indemnifies the bail bondsman from any losses if the defendant misses court and the bondsman losses the full bond amount. In North Carolina the bail bondsman has 150 days to locate the defendant after the failure to appear in court. If the bondsman doesn't produce the defendant by the 150th day. then the bondsman has to pay the bond to the courts. In North Carolina all monies paid on bonds goes to the school system.
